Commentary by Attorney Michael Grossman

Crashes involving vehicles colliding with semi-truck trailers often reveal systemic safety issues, such as poor intersection design or noncompliance with visibility regulations for trailers.

The key question for investigators at this point is what caused the Toyota to hit the trailer. Was the semi-truck crossing the intersection, turning, or stopped? If the trailer was obstructing the northbound lane, investigators need to determine whether the truck driver had the right-of-way and whether the maneuver was executed safely.

At 10 p.m., visibility may have been affected by darkness, fog or other weather conditions. Investigators should determine if these factors contributed to the collision, while also looking at whether the intersection has a history of accidents.

There are safety and compliance issues to be considered with the truck as well. Was the trailer compliant with federal regulations regarding reflective tape, lights and other visibility aids? A lack of proper markings could reduce the trailer’s visibility, especially at night. Investigators should also review the truck driver’s training and history, as well as compliance with hours-of-service regulations to rule out fatigue.

These questions should help the victim’s family understand what happened at that intersection. If the official investigation does not yield sufficient answers, perhaps they should look for a second set of eyes to look into this crash.
