Houston, TX — April 19, 2024, Alicia Spitzer was injured due to an alleged intoxicated driver accident at around 12:30 a.m. on Durham Drive.
According to information released by authorities, the incident took place in the area of Durham Drive and Washington Avenue.

Investigators said that 29-year-old Alicia Spitzer was on foot at the time. Spitzer was attempting to walk east across Durham in the crosswalk. While doing so, it appears a southbound Lexus struck Spitzer, then left the scene of the accident. Authorities reportedly arrested that driver.
Spitzer sustained serious injuries in the accident. The driver was allegedly intoxicated at the time of the accident.

Details from Harris County officials say the driver was charged for failure to stop and render aid. It’s unclear if there are confirmed charges regarding the alleged intoxication. People rightfully see that as a serious offense, so it may seem unusual not to have confirmed charges for intoxicated driving. But folks don’t often realize just how much goes into a proper investigation for intoxicated drivers.
For example, let’s say that alcohol contributed to the crash. Things aren’t always as simple as just getting a driver’s blood-alcohol content, and that’s that. It’s also important to retrace their steps to understand what all led to the crash. Our firm, for instance, handles a lot of cases against negligent alcohol providers who have over-served someone who then caused an accident. When we have to prove someone was intoxicated, we consider everything from BAC to security footage to witness testimony to medical expert testimony to social media posts and texts. And that’s in a civil case where the standard of proof is a lot lower than a criminal case’s standard of “beyond a reasonable doubt.”
That’s why I hope the seeming lack of information here is just due to authorities trying to be as thorough as possible before drawing any conclusions. Intoxicated driving is very serious, so it wouldn’t be good to let someone off the hook just because investigators were being too hasty. That said, if authorities ultimately didn’t feel like pursuing any charges related to intoxicated driving, it would be important to understand why that is and whether or not there could be other avenues to see appropriate consequences for the accident.
