When authorities believe wrong-way driving led to a crash, it understandably raises some serious red flags. It should be clear up front, though, that even wrong-way crashes need thorough investigations. For one, there may have been unusual, unavoidable circumstances. Even things as intricate as road design flaws or vehicle defects can cause crashes like this. It’s important investigations are able to definitely rule that out.
However, the most likely factor is what most people are probably thinking of: drunk driving. If that happens, the situation likely still isn’t open-and-shut. I’ve handled hundreds of cases involving alcohol. Something that goes overlooked far too often is if someone was unlawfully over-served by an alcohol provider. Those negligent establishments can be held responsible if their service leads to people getting hurt or killed.
So as common as the red flags are surrounding details like these, the path forward is likely to be anything but simple or straight-forward. If authorities aren’t taking the time to consider the details of the crash and the events leading up to it, they could be missing something crucial.
