Commentary by Attorney Michael Grossman

Current statements allege that the Volkswagen driver was under the influence of alcohol, and they recommended a charge for intoxication assault. If those allegations are true, are authorities looking into where that alcohol came from? Folks tend to put all of the focus on the drunk drivers in these situations—understandably so. But there’s often a complicit alcohol provider who also broke the law and can be held responsible.

Simply put, it’s illegal in Texas for alcohol providers to over-serve someone who is obviously intoxicated. Doing so exposes those establishments to potential criminal investigations, fines, license suspensions, and liability for resulting injuries. Not only does this help ensure there’s accountability for the alcohol provider’s actions, but it also provides an opportunity to see them clean up their act before more people get hurt. So if authorities aren’t looking into that possibility here, they may be letting someone off the hook for their role in a serious accident.
