Commentary by Attorney Michael Grossman

When people hear about crashes like this one, it’s easy for them to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks often require thorough investigations to understand all contributing factors.

In this incident, it’s essential to determine why the 18-wheeler shifted into the left-most lane at an unsafe time. Several factors could be at play, including driver distraction, misjudgment of the motorcycle’s position, or even failure to properly check blind spots. Each of these factors can significantly impact the dynamics of such accidents.

One critical aspect of this accident is the maneuver executed by the 18-wheeler. Lane changes by large trucks require careful consideration due to their size and limited maneuverability. Investigators need to assess whether the truck driver adhered to proper lane-changing protocols and if they were aware of the motorcycle’s presence before making the move.

The investigation should also examine the condition and maintenance of the 18-wheeler. Regular inspections and proper upkeep are vital for ensuring that commercial trucks operate safely on the road. Any lapses in this area could indicate negligence on the part of the truck driver or the company that owns the vehicle.

Additionally, the company responsible for the 18-wheeler may share in the responsibility for the accident. If the company failed to enforce safety protocols, properly train their drivers, or ensure that their vehicles were in good working order, they could be held accountable for their role in the crash.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it is crucial to consider every factor to ensure that those impacted by the crash receive the clarity and closure they deserve.
