Commentary by Attorney Michael Grossman

When a crash involves a vehicle colliding with a parked semi-truck, the key legal question is whether the truck was parked lawfully and in a manner that ensured it was visible to other drivers. The fatal collision in Perris raises concerns about where the truck was stopped and whether proper precautions were taken to prevent an accident.

One of the first things investigators should determine is whether the truck was legally parked. Semi-trucks are often prohibited from stopping in travel lanes or on certain roadways unless it is an emergency. If the truck was parked in a no-stopping zone, partially blocking the road or positioned in a way that made it difficult to see, that could be a critical factor in understanding how the crash happened.

Another issue is visibility. Federal regulations require parked trucks to use hazard lights, reflective markings and warning devices such as cones or flares when stopped in certain locations. Investigators should determine whether these safety measures were in place and functioning at the time of the crash. If they were not, it could have made it harder for the sedan driver to recognize and avoid the truck in time.

Additionally, road and lighting conditions should be examined. Poor lighting, sharp curves or other environmental factors could have reduced the sedan driver’s ability to see the truck before impact. If the location has a history of similar crashes, that could indicate that design flaws or inadequate signage contribute to unsafe conditions.

While some may assume that the moving vehicle is always at fault in a parked-truck collision, the reality is more complex. A proper investigation should look at whether the truck driver followed all safety regulations and whether any factors outside the sedan driver’s control contributed to the crash. Simply stopping a truck does not absolve its driver of responsibility if it was parked in an unsafe or unlawful manner.
