Commentary by Attorney Michael Grossman

Obviously, it’s important to find out what happened here, since there are plenty of work sites all over the state where workers are able to go home to their families at the end of the day. But on top of that, it’s important to recognize the inherent challenge of any fatal work accident in Texas.

Simply put, Texas has the most complex work fatality laws of any other state in the country. There is not always an automatic path to getting the worker’s family the benefits they need. That can leave families in an unexpected position where they either have to rely on the employer to willingly do what’s best for the family (which is not something I’d take for granted) or otherwise put together a case that argues for a fair resolution on their behalf.

Finding the cause of an accident is one thing, but finding out what comes next for those affected is another. Texas work fatality law may be a legal maze, but it’s one that can be successfully navigated. With clear evidence, unique legal strategy, and prompt action, families can best exercise the rights they’re given under Texas law.
