Commentary by Attorney Michael Grossman
When I see reports of a crash like this, my first thought is that the driver’s loved ones deserve clear answers about what happened. A single-vehicle crash that results in a fire raises serious questions, and in my experience, these incidents are often more complex than they seem at first glance. Before any conclusions are drawn, three key areas need further examination.
First, did authorities conduct a thorough investigation? Single-vehicle crashes are often assumed to be the result of driver error, but that assumption can overlook other contributing factors. Did investigators examine the roadway for hazards such as debris, potholes or sharp curves that could have caused the driver to lose control? Were there any indications that another vehicle may have played a role, such as forcing the car off the road? Given that this happened after midnight, did poor visibility or inadequate lighting contribute to the crash? These factors should all be considered in a thorough accident reconstruction.
Second, has anyone looked into whether a vehicle defect contributed to the crash? The Ford Mustang involved in this crash is a 2000 model, meaning it’s a 25-year-old vehicle with the potential for mechanical failures. Did the brakes, steering or suspension fail at a critical moment? Were the tires in good condition, or did a blowout cause the car to leave the road? Perhaps most concerning is the fact that the Mustang caught fire after the crash. Older vehicles sometimes have fuel system vulnerabilities that can increase the risk of post-crash fires. If a defect made this crash worse than it otherwise would have been, it deserves attention.
Finally, has all available electronic data been collected? While a 2000-model vehicle may not have the same level of electronic monitoring as newer cars, there may still be valuable data to collect. Investigators should look for any nearby surveillance or traffic camera footage that could show how the crash happened. Additionally, phone records may provide insight into whether distraction was a factor. If any witnesses were present, their statements could help reconstruct the moments leading up to the crash.
At the end of the day, a young driver lost his life, and his family deserves to know exactly what happened. A full and thorough investigation is the only way to ensure that no key details are overlooked. If any of these three questions remain unanswered, the victim’s family simply doesn’t have the full story.
