Commentary by Attorney Michael Grossman
When I read about incidents like this one, what stands out to me isn’t just what happened, but what’s missing from the conversation. A crash in Hidalgo County left two young people seriously injured, and the driver now faces intoxication assault charges. But beyond the criminal case, there’s a broader question that often goes unasked:
Where did the driver get their alcohol? Was it at a bar, a restaurant, or somewhere else that serves the public? And if so, did someone continue to serve them even after they were clearly intoxicated? That’s the kind of question dram shop law is built to answer.
Texas law allows those affected by drunk driving crashes to explore whether an alcohol provider contributed to the harm by overserving an obviously intoxicated person. It’s not always obvious, but there may be more to this story than people realize.
In many drunk driving crash investigations, authorities lack the resources and support necessary to investigate where the alleged drunk driver was drinking prior to the crash. That’s why it’s important for those affected to ask these questions and seek the answers they deserve.
Key Takeaways:
- Dram shop laws in Texas provide a legal avenue to hold alcohol providers accountable if they overserve patrons who are obviously intoxicated.
- Investigating the source of alcohol in drunk driving cases is crucial to understanding all contributing factors and preventing future incidents.
- Many people are unaware that they have the right to pursue legal action against negligent alcohol providers; understanding these rights is the first step toward accountability.
