Commentary by Attorney Michael Grossman

People sometimes think of commercial truck accidents as just really big car accidents. Police take care of the scene, they file their reports, and that’s that. However, commercial truck wrecks involve inherent unique challenges that police aren’t always equipped to handle. If they lack the proper tools or training to look into certain details, they may miss something important.

Was the truck driver within their hours of service limits? Were they speeding? Did a tire blow out due to poor maintenance or a defect? Did this involve an employer who demanded the truck driver meet unreasonable deadlines? Were there issues with the road itself that led to the crash? Was there a serious medical condition that resulted in an emergency? Does the crash involve a company who has a history of drivers causing accidents?

Likely or not, I’ve seen these kinds of factors crop up across hundreds of different commercial vehicle accidents. Those details came to light because independent accident reconstructionists have the experience and equipment to at least rule them out. Some authorities are capable of this, as well, but the problem arises when folks assume police are going to get all the facts only to find they come up short. Having measures in place sooner rather than later to prevent these shortcomings, then, is always worth considering.
