Commentary by Attorney Michael Grossman
When I see reports of an 18-wheeler overturning, my first thought is whether investigators will be able to determine exactly what went wrong. Rollovers involving large commercial trucks are complex events that can be influenced by a variety of factors, and without a thorough investigation, critical details could go unnoticed. To get real answers, there are three critical questions that must be asked.
The first question is whether authorities conducted a thorough investigation. Law enforcement officers work hard to document crash scenes, but not all departments have the specialized training required to analyze commercial truck rollovers in detail. In a case like this, investigators should examine roadway conditions, speed, traffic patterns, and whether any external factors—such as sudden maneuvers to avoid obstacles—played a role. Additionally, the truck’s cargo load should be reviewed, as improperly secured or unbalanced freight can contribute to rollovers. If these aspects aren’t fully analyzed, key details could be missed.
The second question is whether a vehicle defect played a role. Commercial trucks rely on intricate braking, suspension, and steering systems, and a failure in any of these components could contribute to a loss of control. Mechanical issues such as brake malfunctions, tire blowouts, or problems with the truck’s stability control system should be ruled out through a forensic examination of the vehicle. Unfortunately, these factors are often overlooked unless someone pushes for a deeper investigation. Preserving the truck for inspection is critical in cases like this.
The final question is whether all available electronic data has been collected. Most commercial trucks are equipped with an electronic control module (ECM) that records key crash-related data, including speed, braking, and steering inputs leading up to the crash. Additionally, many trucking companies install GPS tracking systems and onboard cameras that could provide further insight. If investigators don’t act quickly to secure this information, it may be lost before anyone realizes its importance.
At the end of the day, determining why this crash happened isn’t just about documentation—it’s about ensuring that all the right questions have been asked and answered. If external factors, mechanical failures, or missing data played a role, those affected by this crash deserve to know. Serious crashes change lives in an instant, and at the very least, the community owes it to those involved to uncover the truth.
