Commentary by Attorney Michael Grossman

When I see reports of an 18-wheeler overturning, especially one carrying a heavy and shifting load like logs, my first thought is whether investigators will be able to determine exactly what went wrong. Rollovers like this can happen for a variety of reasons, and without a thorough investigation, critical details could go unnoticed. To get real answers, there are three critical questions that must be asked.

The first question is whether authorities conducted a thorough investigation. Law enforcement officers work hard to document crash scenes, but not all departments have the specialized training needed to investigate commercial truck rollovers in depth. In a case like this, investigators should be looking at the road conditions, the truck’s speed, and whether the roadway design could have contributed to the crash. Additionally, logging trucks operate with high centers of gravity, making cargo weight distribution a crucial factor. If the load wasn’t properly secured, it could have shifted, causing instability. If investigators don’t carefully analyze these factors, key details may be missed.

The second question is whether a vehicle defect played a role. Commercial trucks rely on complex braking, suspension, and steering systems, and a mechanical failure in any of these components could contribute to a rollover. Equipment issues such as brake malfunctions, tire blowouts, or trailer coupling failures should be ruled out through a forensic inspection of the truck. Unfortunately, mechanical failures are often overlooked in crash investigations unless someone pushes for a deeper examination. Preserving the vehicle for inspection is critical in these cases.

The final question is whether all available electronic data has been collected. Most commercial trucks are equipped with an electronic control module (ECM) that records key crash-related data, including speed, braking, and steering inputs leading up to the crash. Additionally, many trucking companies install GPS tracking systems and onboard cameras that could provide further insight. If investigators don’t move quickly to secure this information, it may be lost before anyone realizes its importance.

At the end of the day, getting to the bottom of a crash like this isn’t just about determining what happened—it’s about ensuring that all the right questions have been asked and answered. If external factors, mechanical failures, or missing data played a role, those affected by this crash deserve to know. Serious crashes change lives in an instant, and at the very least, the community owes it to those involved to uncover the truth.
