Commentary by Attorney Michael Grossman
When a vehicle drifts off the roadway and overturns after an overcorrection, the explanation is often summarized as “loss of control.” But that doesn’t answer the critical question of what caused the driver to lose control in the first place.
1. Did the authorities thoroughly investigate the crash?
It’s not clear whether investigators performed a full reconstruction or just documented the rollover. A careful review would involve measuring tire marks, mapping the vehicle’s path, and checking whether the driver attempted evasive maneuvers. It’s also important to consider whether distraction, fatigue, or a sudden health event may have played a role. Without this level of detail, the true chain of events may remain hidden.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
Overcorrection crashes can sometimes be triggered by mechanical issues. A steering malfunction, brake problem, or sudden tire failure can cause a vehicle to veer and make recovery difficult. Pickup trucks like the Nissan Titan, with a higher center of gravity, are especially prone to rolling when stability is lost. Unless the vehicle was carefully inspected soon after the crash, signs of a defect may already have been overlooked.
3. Has all the electronic data relating to the crash been collected?
Modern vehicles like the Titan often carry event data recorders that log speed, steering, braking, and stability system activity in the moments before impact. That data could show whether the driver attempted to regain control or if the truck behaved unpredictably. Investigators should also consider GPS records, phone activity, and nearby camera footage to build a more complete picture.
Even single-vehicle rollovers are rarely simple. To move beyond assumption, investigators must ask the deeper questions that explain why control was lost in the first place.
Key takeaways:
- A full crash reconstruction is needed to understand why the truck left the roadway.
- Mechanical issues such as steering, brake, or tire problems could have played a role.
- Vehicle data, phone records, and GPS can reveal what happened in the moments before the rollover.
