Austin, TX — August 1, 2024, Victor Gomez Sr. was killed as the result of a work accident that happened at a site along Tesla Road.

The Occupational Safety and Health Administration released preliminary details about the accident, saying it happened at 13101 Tesla Road, just off TX-130.

Few details about the accident are available right now. OSHA reports that 45-year-old Victor Gomez Sr. was working when there was an electrical arc flash from a nearby power supply. As a result, Victor Gomez was fatally electrocuted.

There were no other reported injuries. The OSHA inspection summary lists three alleged serious citations. No further information can be reported at this time.

Even without clear details about what went wrong here, fatal work accidents in Texas are inherently challenging. We have the most complex work fatality laws of any other state in the country. While people tend to assume OSHA covers everything and there is an automatic process to help the victim’s loved ones, that’s not always true.

Since employers are not required to subscribe to the workers’ comp system, some families end up having to work with the victim’s employer to get the benefits they need. It might not surprise anyone to learn that in my over 30 years of experience dealing with employers, they rarely place the needs of a worker’s family above their own.

That’s why it’s important after a fatal work accident for a family to understand what sort of path lies ahead for them. That way, they can arm themselves with the proper evidence, legal tools, and experienced allies needed to successfully navigate the legal maze that is Texas work fatality laws.
