An investigation is underway following a UTV accident that left two people injured during the evening hours of February 2nd. According to official reports, a UTV with two occupants was traveling on highway 86 near the town of Cassville when for unknown reasons the vehicle lost control at a curve and went off-road where it struck a sign and overturned.

When first responders arrived on the scene they found that both occupants had sustained serious injuries and they were transported to the hospital for treatment. Commentary by Attorney Michael Grossman

When people hear about a UTV accident, they often assume that excessive speed or driver error was to blame. However, experience has shown me that crashes like these are often more complex than they appear. Before reaching any conclusions, it’s important to ensure that the investigation answers three key questions.

First, did the authorities thoroughly investigate the crash? UTV accidents present unique challenges because these vehicles are designed for off-road use, but they’re often operated on paved roads where handling characteristics can change dramatically. Investigators will likely document skid marks, vehicle position, and witness statements, but key questions remain: Was the curve in the road particularly sharp or poorly marked? Were there any road hazards, such as loose gravel or debris, that contributed to the loss of control? Did authorities evaluate whether the UTV was operating within its design limitations? Without a detailed review, important details could go unnoticed.

Second, has anyone looked into the possibility that a vehicle defect contributed to the crash? UTVs are prone to stability issues, especially at higher speeds or when navigating turns on pavement. A defect in the steering, braking, or suspension system could have caused or contributed to the loss of control. Additionally, UTVs often rely on electronic stability control systems to prevent rollovers—was this system functioning properly? Without a forensic examination of the vehicle, it’s impossible to know whether mechanical failure played a role. Unfortunately, these types of defects are rarely considered unless someone takes steps to preserve the vehicle and conduct a proper analysis.

Finally, has all the electronic data related to the crash been collected? Many modern UTVs are equipped with electronic control modules (ECMs) that store key data, such as speed, throttle input, and braking before impact. Additionally, nearby traffic cameras or private security footage may have captured the incident, providing valuable insight into how the crash unfolded. If authorities don’t act quickly to secure this information, critical evidence could be lost, making it more difficult to determine what really happened.

At the end of the day, those injured in this crash deserve clear answers. UTV accidents can be especially complex because they involve vehicles that may not have the same safety features as passenger cars, and the least we can do as a community is ensure that every possible factor is examined so that those affected aren’t left with unanswered questions.
