Commentary by Attorney Michael Grossman

If the allegations here are true, then no doubt people will want to see some accountability. However, that accountability may not begin and end at the alleged drunk driver. I’ve handled hundreds of alcohol-related accident cases, and many of them involve an accomplice: a negligent alcohol provider.

Texas dram shop laws prohibit alcohol providers from serving someone who is obviously intoxicated. If the Ford driver had been drinking at a bar or restaurant before the crash and was over-served, that establishment may also bear responsibility for what happened here.

Too often, though, authorities focus solely on the driver while ignoring the role an alcohol provider may have played. This allows those negligent establishments to continue putting lives at risk. Simply put, the families I’ve helped over the years didn’t just want some bad guy to blame. They wanted to know that those who wronged them would face appropriate consequences. That’s why it’s important investigators don’t just put all of their focus on one person when there could be an outside party who also broke the law and contributed to the accident.
