Commentary by Attorney Michael Grossman

When people hear about crashes like this one, it’s easy to assume they are a result of simple driver error. However, in my experience, accidents involving large trucks tend to be more complicated, and it’s essential to thoroughly investigate all factors contributing to these incidents.

In this case, a truck that had been temporarily disabled on the shoulder tried to merge back into traffic. There are many questions that need answers. Was the driver distracted or fatigued? Was there enough time and space to safely merge? Data from vehicle event recorders, traffic cameras, and witness statements can help clarify these details.

The trucking company’s role is also crucial. Drivers need proper training and must follow safety protocols when rejoining traffic from the shoulder. If the company failed in these areas or pushed the driver too hard, they could share responsibility for the crash.

Additionally, the condition of both trucks must be examined. Was the merging truck properly maintained? Did it have functioning lights and signals? Maintenance records and inspections will reveal if mechanical issues played a role.

Investigations should look beyond the crash scene to find the full story. This includes checking the truck drivers’ logs and driving histories and possibly consulting with accident reconstruction experts.

The goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain vital evidence, it’s crucial to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
