Commentary by Attorney Michael Grossman

With a serious multi-vehicle truck accident like this, one key factor should be on people’s minds: preserving evidence. There is all kinds of time-sensitive evidence after a crash that needs careful attention so it can be secured and used later by the victims and families. Unfortunately, this is not always what authorities prioritize.

A crash like this is sure to leave a chaotic scene—all the pictures I’ve seen seem to reflect that. With authorities putting so much effort in quarantining, then clearing the scene, and as they work to get patients into ambulances and out for treatment, the accident reconstructions are likely to take a backseat. I can’t count how many times I’ve had commercial truck wrecks come across my desk where authorities just never bothered securing evidence because they were too busy getting traffic flowing again.

That’s why it can be helpful to consider independent accident reconstructions as soon as possible after a commercial truck wreck. It isn’t necessarily that people shouldn’t trust authorities to do a good job. It’s just not worth the risk of letting crucial evidence go unnoticed. Sometimes, independent investigations confirm that authorities were diligent in preserving evidence. Other times, those independent investigations catch important details that could have been lost had someone not stepped in to catch them. Either way, time is of the essence.
