St. Louis County, MO — May 11, 2024, two people were injured following a truck accident at approximately 7:30 p.m. along Interstate Highway 255.

The accident unfolded when a 1999 Mercury Grand Marquis, traveling southbound, was sideswiped by a 2024 Volvo Tractor that made an unsafe lane change.

The initial impact caused the Mercury to spin and subsequently veer off the road, striking a concrete wall. After correcting its path, the car re-entered the roadway, only to be struck again by the semi-truck, this time on the passenger side.

The driver and the passenger of the Mercury were both transported to a nearby hospital for medical treatment. The passenger suffered serious injuries as a result of the crash.

When people hear about a crash involving a semi-truck, they might quickly assume it’s a straightforward ‘open and shut’ case. However, in my 30 years of handling truck accident claims, I’ve learned that such assumptions are seldom correct. Every incident involving a large vehicle introduces complex layers of responsibility and compliance that demand a detailed examination. Allow me to explain.

Firstly, we must consider the training and preparedness of the truck driver involved in the lane change. Was this maneuver a result of inadequate training or perhaps a momentary lapse in judgment? Thorough investigations often reveal that what might appear as a simple error could actually stem from deeper issues within the trucking company’s operational protocols.

Moreover, we must scrutinize the safety systems in place. Were all safety mechanisms on the truck functioning correctly? Advanced technologies like blind-spot alerts and lane departure warnings are critical in preventing such incidents but they must be properly maintained and actively utilized by the trained driver.

Finally, examining the role of the trucking company’s policies and their enforcement is crucial. Does the company culture promote safety first, or are drivers pressured to meet deadlines at the expense of safe driving practices?

What do all of these avenues of investigation have in common? You can’t get the answers you need by focusing exclusively on the crash scene. This surprises most people who find themselves in a commercial vehicle crash. The police crash report may answer some of these questions, but not all of them. To get to the truth and know who to hold accountable generally requires a more thorough investigation than what the authorities perform.
