Commentary by Attorney Michael Grossman
When multiple vehicles are involved in a serious crash, especially one that results in people being airlifted to the hospital, the legal picture can get very complicated, very quickly. In my experience, the biggest challenge in these cases is figuring out who initiated the chain reaction and whether all parties were acting reasonably in the moments leading up to the crash.
That analysis starts with the basics: Did any driver make an unsafe lane change, follow too closely or fail to react appropriately to traffic conditions? In a case involving a box truck, it’s also important to evaluate stopping distances and blind spots, since commercial vehicles have different performance characteristics than passenger cars. It’s not unusual for one driver to make a mistake, but the consequences get magnified when a heavier vehicle is involved.
To sort out fault, investigators will need to reconstruct the crash based on physical evidence — like impact damage and skid marks — as well as witness statements, dashcam footage or traffic cameras, if any exist. In my experience, even when the official crash report assigns blame, it rarely gives a complete picture. It’s not uncommon for the real causes to come into focus only after ECM downloads and data reviews.
Until all that’s done, it’s simply too early to say who should be held accountable. But based on how these crashes typically unfold, I can say that if all investigators do is document who hit whom, there’s a good chance they’ll miss the bigger story.
