Commentary by Attorney Michael Grossman
Collisions involving passenger vehicles and 18-wheelers often raise questions about what caused the crash and whether it could have been prevented. While initial reports don’t provide much detail, in my experience, understanding what happened in these incidents requires looking beyond the immediate circumstances to examine the contributing factors.
One key area of focus is the actions of both drivers leading up to the collision. Investigators should determine whether either driver was distracted, fatigued, or impaired, as these are common factors in crashes. Additionally, they should evaluate whether either vehicle failed to yield the right of way or misjudged the other’s speed or distance. Determining which driver, if any, made a critical error is central to understanding how responsibility might be shared.
It’s also important to examine the condition of the 18-wheeler involved. Commercial trucks require regular maintenance to ensure they are safe to operate, especially at highway speeds. Mechanical failures, such as brake issues or steering problems, can quickly escalate into dangerous situations. Reviewing the truck’s maintenance logs and inspection history could reveal whether the trucking company upheld its duty to maintain the vehicle properly.
Lastly, the trucking company’s policies and procedures should also be reviewed. Companies are responsible for ensuring their drivers are adequately trained to operate their vehicles safely, particularly in complex traffic environments like highway intersections. If any deficiencies in training, scheduling, or vehicle upkeep are discovered, the trucking company could bear some responsibility for the crash.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
