Commentary by Attorney Michael Grossman

When people see pedestrian accidents, they’re generally quick to jump to conclusions. But just like any serious accident, it’s important to have all the facts. There could always be extenuating circumstances to consider.

Have authorities examined road conditions? Lighting in the area? Signage? Is this an area known for pedestrian accidents? Was alcohol a factor? Did the truck have a dash cam? Was there a nearby business or residence with a security camera that had a view of the road?

Likely or not, investigations should be able to rule out these potential factors. If they don’t, they could leave important issues unaddressed, and they could end up coming to a conclusion that undiscovered evidence might contradict. That’s why it’s sometimes best in these situations to have more than one set of eyes looking things over to ensure nothing slips through the cracks.
