Commentary by Attorney Michael Grossman
When a driver is seriously injured in a crash caused by another vehicle failing to yield, it’s easy to focus only on what happened in the moment. The problem, though, is if that’s the only thing that gets attention. People are sometimes too quick to assume that an obvious wrongdoer makes a crash open-and-shut. A proper investigation, though, should include all kinds of possible contributing factors.
To name a few examples, was alcohol involved? Have authorities pulled cell phone records? Did they secure data from the vehicles involved? Have they examined the victim’s vehicle for possible defects, such as faulty seatbelts, airbags, or crash avoidance systems? Are there issues with this particular intersection that need to be addressed? Are there any nearby cameras which may have captured the incident on video?
I can’t begin to count how many times people have come to me with a seemingly straight-forward car accident only for our investigations to show authorities completely overlooked these important details. At the end of the day, victims and families need as much evidence as possible telling their side of the story. That means considering even complex or unlikely possible factors, which authorities can’t always guarantee they’ll look into.
Takeaways:
- Failure-to-yield crashes require careful reconstruction to uncover all contributing factors.
- Mechanical or safety system issues may have influenced the crash or worsened the outcome.
- Vehicle data, phone use, and area footage are essential to completing the picture.
