Commentary by Attorney Michael Grossman
With authorities recommending a citation here, the situation may seem pretty open-and-shut. But I always tell folks that citations and even criminal charges are not the beginning and end of a serious accident. They are often just a piece of the much larger puzzle.
A big reason for this is because the evidence authorities need for their own purposes don’t necessarily align with victims and families who seek out alternative legal avenues for holding negligent drivers accountable. That requires the kind of evidence needed for anticipating and countering common insurance company tactics. Walking in with nothing but a preliminary police investigation is rarely a recipe for success.
So while details about what happened here may seem straight-forward, it’s prudent to treat all car accidents like the complex situations they usually are. At worst, an abundance of caution might simply reaffirm important details. At best, though, it can make all the difference in getting victims and families the resolution they deserve.
