Commentary by Attorney Michael Grossman

There are obviously all kinds of factors that warrant investigation after a serious crash, but one in particular comes to mind here. Have authorities looked into the possibility of a vehicle defect? While I can’t say what all happened here, it’s a bit of a red flag when only one person in a crash is seriously injured. Sometimes, that can be a sign that something that was supposed to protect them failed to do so.

This isn’t just mere speculation. I had a case not long ago that’s a clear example of this. In short, someone was severely injured in a crash where they should have been more or less okay. While authorities were quick to assume that the victim simply wasn’t wearing their seatbelt, we made sure the vehicle actually got a proper inspection from specialists. They were able to determine the victim’s seatbelt was defective and failed to lock during the crash. Had it functioned properly, the victim likely would have been okay.

I’m not saying anything like that happened here, but in that example, a crucial detail nearly slipped through the cracks because authorities outright overlooked it. If authorities were similarly haphazard in their efforts here, could there be more to the story that still needs to be brought to light?
