Commentary by Attorney Michael Grossman
When someone is driving the wrong way down a major road at night and ends up seriously hurting another person, it’s natural to wonder: how does something like that happen? And when authorities say alcohol was involved, the next question should be: Where did the drinking happen, and who served it?
According to reports, the wrong-way driver in this case has been charged with intoxication assault, which strongly suggests he was impaired at the time of the crash. That alone makes it critical to find out whether a bar, restaurant or other alcohol provider may have overserved him before he got behind the wheel.
Texas dram shop laws are clear: it’s against the law for alcohol providers to serve someone who is obviously intoxicated. When that happens and someone ends up seriously hurt, the law allows those affected to hold the alcohol provider accountable. That’s not just about financial responsibility. It’s about getting answers and protecting public safety.
In situations like this, it’s easy to focus only on the driver. But if a business contributed to the crash by ignoring clear signs of intoxication, that deserves attention too. More often than not, that part of the investigation never gets the follow-through it needs.
From where I sit, a crash like this should lead to a full investigation; not just into what happened on the road, but into what happened before the driver ever turned the key. That’s how we make sure those affected get the full truth, and how we help prevent similar crashes down the line.
