UPDATE (July 9, 2024): In recent statements, it appears the Federal Motor Carrier Safety Administration (FMCSA) determined the truck driver’s employer “to be an imminent hazard to public safety and ordered the carrier to immediately cease all interstate and intrastate operations.”
Like I discussed in my original comments on this crash, it often comes to light that the trucking companies involved in these accidents are themselves negligent and a danger to those around them. However, it’s important there are steps taken to determine if the alleged shortcomings of this employer played a direct role in the crash itself. That isn’t necessarily something the FMCSA does on their own, which is why there may still be steps to take here before there can be a proper conclusion.
UPDATE (June 14, 2024): Recent reports have been released which clarify some of the details of what occurred leading up to and during this accident. According to these reports, a 47-year-old man was traveling in a southbound 18-wheeler hauling pipe and angle iron when, for reasons yet to be confirmed, the truck failed to maintain control as it attempted to pass other vehicles. It reportedly sideswiped five vehicles before becoming jackknifed and losing its load.
The man who lost his life as a result of this accident has been identified as 64-year-old Scott Miller. One other victim, a woman, sustained serious injuries, as well. The man who was behind the wheel of the 18-wheeler is reportedly facing various charges, including vehicular homicide, vehicular assault, reckless driving, and driving without a commercial driver’s license. The investigation is still ongoing.
Conifer, CO — June 11, 2024, one person was killed following a lost load truck accident at around 5:30 p.m. along U.S. Highway 285.
According to authorities, an 18-wheeler was traveling southbound with a load of pipe and angle iron on its trailer on U.S. Highway 285 in the vicinity of C.R. 285E when the accident took place.
The initial cause of the accident remains unclear. Officials indicate that, for as yet unknown reasons, the truck failed to safely maintain its lane of travel. It reportedly veered off of the edge of the highway where it overturned onto its side, causing its load to be dumped onto five other vehicles. One person who had been an occupant of one of those vehicles apparently suffered fatal injuries as a result. Additional details pertaining to this incident—including the identity of the victim—are not available at this point in time. The investigation is currently ongoing.

When people hear about a fatal accident involving a lost load from a truck, they often assume it’s a straightforward case of driver error or poor load securing. In my experience, however, these incidents are rarely that simple. Accidents like this typically involve multiple factors that need thorough investigation to understand what went wrong and who is responsible.
First, it’s crucial to determine why the truck veered off the road. Was the driver distracted, fatigued, or dealing with a medical emergency? Additionally, did mechanical failure play a role? Gathering data from vehicle event recorders, reviewing traffic camera footage, and analyzing witness statements can provide crucial insights into these questions.
Next, we need to consider the trucking company’s role. Was the driver adequately trained and adhering to safety protocols? Trucking companies have a responsibility to ensure their drivers are well-prepared for the demands of the road. If the company neglected proper training or pushed the driver to meet unrealistic deadlines, they might share responsibility for the incident.
Additionally, examining the truck’s condition is vital. Was the vehicle properly maintained? Mechanical failures, such as brake malfunctions or tire blowouts, can significantly contribute to accidents. Reviewing maintenance records and conducting thorough inspections of the vehicle can reveal if such problems were a factor.
Furthermore, the way the load was secured needs careful scrutiny. Were the pipes and angle iron properly fastened and balanced?
