Arlington, TX — November 23, 2024, Scott Davis was injured due to an alleged drunk driver accident that happened around 10:49 p.m. on Brown Boulevard.

Authorities with the Arlington Police Department say that the crash happened off the corner of the Brown Boulevard and Ballpark Way intersection.

Initial details about the accident say that 62-year-old Scott Andrew Davis was on foot at the time in the area of Brown Boulevard. While there, a westbound Nissan Altima reportedly struck Davis. Davis sustained serious injuries as a result.

The driver involved was allegedly under the influence of alcohol at the time of the accident. Authorities recommended a charge for intoxication assault.

If the current allegations are true, a key detail remains unclear: where did this alleged alcohol come from? Folks understandably put focus on drunk drivers after accidents like this, but they may not realize there’s often an accomplice to drunk driving accidents: a negligent alcohol provider.

Simply put, bars, restaurants, stores, and venues that serve someone who is obviously intoxicated can face potential criminal investigations, fines, suspended licenses, and liability for resulting injuries. Too often, though, authorities fail to extend their efforts beyond a drunk driver. I’ve had hundreds of cases against negligent alcohol providers. Rarely, if ever, do authorities conduct their own investigations. Often, we’re the ones bringing the establishments to light and handing evidence to the authorities so they can ensure there are adequate consequences.

It’s possible authorities have been more thorough behind the scenes to investigate the possibility there was a negligent alcohol provider involved here. In my experience, though, it’s not prudent to take that for granted.
