Commentary by Attorney Michael Grossman
With authorities blaming someone for failing to yield here, things may seem open-and-shut. Unfortunately, the simple fact the victim was on a motorcycle can create unique hurdles. A lot of people are unfortunately biased against riders, so they may be open to blame-shifting techniques that insurance companies are all too eager to take advantage of.
This is why evidence is so important. A preliminary report can give an impression of what happened, but telling the whole story means having as much evidence as possible showing definitely who was in the wrong. That might take more thorough investigations than authorities alone were willing to do.
