Commentary by Attorney Michael Grossman
Generally speaking, commercial drivers are held to higher standards than average motorists. They tend to have more training, more experience, and larger burden than the rest of us. Few have a higher expectation than bus drivers, considering they’re responsible for the safety our kids. So while any driver failing to yield is a huge problem, a bus driver failing to yield is inexcusable. Short of some one-in-a-million, unavoidable factor, it’s unlikely this happened for any reason than the bus driver making a mistake.
But that’s not where my concern ends. What I and no doubt many others want to know is if this sort of incident was foreseeable. Does the driver have a history of making mistakes? Are they qualified to drive a bus? Do they regularly engage in behavior that would naturally lead to a crash? Could it be that the district or company in charge of maintaining the buses failed to do so, and it led to brake or tire failure? If these aren’t things authorities are looking into yet, they may be missing something crucial.
