Commentary by Attorney Michael Grossman
If the allegations here are true, then it’s only right that there be significant and appropriate consequences for the alleged drunk driver. That said, is there more to the story? In my experience, crashes like this often involve an accomplice who also needs to be held accountable: a negligent alcohol provider. Unfortunately, that’s not something authorities often look into on their own.
Case in point, I handled a crash not long ago about a family hit head-on by a drunk driver, nearly killing their young son. They asked us to look things over to make sure authorities weren’t missing anything important. They were just being cautious, but it turned out authorities did overlook something important. The drunk driver was unlawfully over-served by a bar.
Under Texas law, bars and other establishments can be responsible when they unlawfully over-serve someone who is obviously intoxicated. Evidence we uncovered showed the bar in that case continued to serve the drunk driver well beyond the point of reason—he could barely walk, let alone drive. This exposed the bar to potential criminal investigations, fines, and ultimately liability for the boy’s injuries their over-service led to. Had things been left solely up to the authorities, it’s likely that bar never would have been called out on their reckless and unlawful behavior.
To be clear, it’s possible nothing like that happened here, or it’s possible authorities have already been working hard to investigate this possibility. However, I’ve handled hundreds of alcohol-related accidents, and it’s frankly risky to take for granted that authorities are going to get the whole story. There may be time-sensitive evidence out there not getting the attention it deserves. Victims and families involved in a crash like this should feel confident that all who wronged them are going to face appropriate consequences. That’s not likely to happen if investigators aren’t considering this accident from all legal angles.
