Commentary by Attorney Michael Grossman

When people see OSHA alleging violations after a work fatality accident, they often think things are open-and-shut from there. In reality, Texas has the most complex work fatality laws in the whole country. That means families can’t just rely on OSHA allegations, especially when it comes to getting a fair outcome for their loss. That often requires navigating a complex legal maze where there isn’t always a guarantee that families will receive benefits. Instead, it may be up to them to have the right evidence and legal tools to compel an employer to agree to a resolution that’s appropriate. OSHA investigations may help in that regard, but they rarely are enough on their own.
