Commentary by Attorney Michael Grossman

Regardless of what happened here, two things always remain consistent between every fatal work accident I’ve handled across a more than 30 year career.

One is that the worker’s family deserves answers. Folks might think that comes through OSHA, but they tend to have their own priorities. Even when they do provide answers for a worker’s family, their investigations can take six months to over a year to complete. Most families will need information long before that, and most everyone would agree waiting that long just isn’t optimal.

Two, Texas has the most complex work fatality laws in the whole country. There isn’t always an automatic process for getting a worker’s family the resolution they deserve. This can often fall to them to seek out, and that means navigating a legal maze which employers inherently have a head start in. Getting families on equal footing, then, usually requires extensive legal strategy and clear evidence that authorities aren’t likely to help with on their own.

So while the details surrounding this accident remain unclear, I have no doubt there will be challenges ahead for the victim’s loved ones. The question is how long will it take to prepare the family for those challenges and give them the tools they need to seek a proper resolution under Texas law.
