Commentary by Attorney Michael Grossman

Whenever wrong-way crashes happen, I often see the same reaction from the public: How can we prevent these awful accidents? There are multiple valid answers, but there’s one I rarely see get enough attention. Ultimately, there needs to be an investigation into the possibility the crash involved a driver who was unlawfully over-served by an alcohol provider. Let me explain why.

Things like improving signage, lighting, and road design can absolutely help. For example, there was a tollway here in DFW where simply lowering warning signs that were installed too high helped reduce the number of incidents where people got on the wrong side of the road. But in the vast majority of wrong-way accidents, the person going the wrong way was dangerously intoxicated. That often happens when people go to bars, restaurants, and other establishments, and those alcohol providers recklessly over-serve people to the point they’re no longer aware of their surroundings.

As such, holding those negligent alcohol providers accountable naturally helps to prevent wrong-way accidents. Alcohol providers can potentially face criminal investigations, fines, suspended licenses, and liability for resulting deaths or injuries. But if investigations aren’t thorough enough, there may be negligent alcohol providers flying under the radar, and they can simply continue putting lives at risk.

So while I can’t say what did or didn’t lead to this accident, it’s important to consider all possible contributing factors, likely or not. Not only are there families who deserve answers, but there’s also a community that has an interest in making their roads safer.
