Commentary by Attorney Michael Grossman
It’s important to keep in mind that single-vehicle accidents can be incredibly complex, and authorities can easily overlook certain details, especially if something else catches their attention. It can lead to situations like one I handled not long ago where authorities were so focused on blaming the driver they didn’t realize the victim’s seatbelt failed due to a defect. It was a serious issue that even the victim didn’t know about, and it was ultimately the cause of the injuries, rather than whatever caused the actual crash. That may not be all that common, but it happens, and it and other factors like it need attention. The questions, then, is what factors are being looked into here, and are authorities taking steps to ensure nothing slips through the cracks?
