Commentary by Attorney Michael Grossman

A crash where a vehicle collides head-on with a stopped delivery truck raises serious questions about why that truck was stopped in the first place. My experience handling truck accident cases tells me that stationary commercial vehicles in active traffic lanes are often a recipe for disaster, and investigators need to take a close look at whether this situation was avoidable.

One of the most important questions is whether the UPS truck had a legitimate reason to be stopped in the northbound lane. Delivery trucks frequently make roadside stops, but were hazard lights or warning signals in use? Was the truck pulled as far off the road as possible? If not, that could be a critical factor in why this crash happened.

Investigators should also examine whether road design contributed to the wreck. Some roads don’t have proper shoulders or designated pull-off areas for delivery vehicles, forcing drivers to stop in traffic lanes. If this stretch of Gus Hill Road has a history of similar incidents, that could indicate a larger safety issue that needs to be addressed.

Additionally, visibility should be considered. Was the road curved or hilly, limiting the Ford driver’s ability to see the stopped truck in time? Were weather conditions or poor lighting a factor? Just because a truck is stopped legally doesn’t mean it was necessarily positioned in a way that gave approaching drivers enough time to react safely.

While authorities are still investigating, this crash highlights an ongoing concern with how delivery vehicles operate on two-lane roads. A full investigation should go beyond the initial impact and determine whether the truck’s position, road conditions or visibility issues played a role in this fatal collision.
