Commentary by Attorney Michael Grossman

When I read about a crash like the one in Uvalde that left a man dead after his pickup overturned, some might assume it was simply a case of driver error. While that’s possible, assumptions won’t help anyone understand what really happened. Instead, it’s important to ask the right questions to ensure that all potential contributing factors are properly examined. To that end, there are three critical questions that need to be considered.

First, did the authorities conduct a thorough investigation? In single-vehicle crashes, law enforcement sometimes treats the case as straightforward and doesn’t look deeper. However, was roadway debris, an unexpected mechanical failure, or another driver’s actions involved? If investigators don’t take the time to explore all possibilities, they could overlook critical details that change the narrative of the crash.

Second, has anyone explored the possibility of a vehicle defect? Tire blowouts, steering malfunctions, and brake failures can all cause a driver to lose control, leading to an accident that might appear to be their fault but was actually caused by mechanical failure. If a defect played a role, it’s crucial to identify it—especially if others could be at risk.

Lastly, have investigators gathered all available electronic data? Many modern vehicles contain event data recorders that store information about speed, braking, and steering inputs just before a crash. That data could clarify whether the driver attempted to correct an issue, whether the vehicle responded as expected, and whether outside factors contributed. Additionally, nearby security or dash cameras could offer valuable insight, but if authorities don’t act quickly, that evidence could be lost.

At the end of the day, answering these questions could be essential to understanding what really happened and why. A thorough examination of all three of these issues—including the quality of police investigations, possible vehicle defects, and electronic data—is the least that can be done to ensure that those affected by the crash receive the clarity they deserve.
