Robert Nielsen, 2 Injured in Truck Accident on U.S. 63 in Bremer County, IA

Ahead of the Pontiac, an 18-wheeler with an oversized load—escorted by two pilot cars—was apparently attempting a right turn to head westbound on State Highway 188. Officials indicate that, for as yet unknown reasons, the Pontiac attempted to pass the 18-wheeler on the right at the same time. A collision followed between the Pontiac and the right side of the 18-wheeler. The impact apparently caused the Pontiac to overturn, coming to a stop resting on its roof.

Nielsen and the two people who had been in the passenger vehicle with him suffered injuries of unknown severity; they were each transported to local medical facilities by EMS in order to receive necessary treatment. Additional details pertaining to this incident are not available at this point in time. The investigation is currently ongoing.

Commentary by Attorney Michael Grossman

When a crash occurs between a passenger vehicle and an 18-wheeler hauling an oversized load, the key question isn’t just what happened, but why it happened. In my experience handling truck accident cases, wrecks like this often involve multiple contributing factors that aren’t immediately obvious from the scene alone.

Was the truck’s turn properly executed and signaled? Oversized loads are challenging to maneuver, especially when making turns at intersections. Drivers must take extra care to signal clearly and allow enough space to complete the turn safely. Investigators should review dashcam footage, pilot car communications, and witness statements to determine whether the truck driver followed proper procedures and whether the pilot cars adequately warned surrounding traffic.

Did the Pontiac’s driver misjudge the situation? Attempting to pass a turning truck on the right can be dangerous, particularly when the truck requires extra space to complete the maneuver. Investigators should determine whether the Pontiac’s driver had enough time to recognize the truck’s movement and whether visibility or road conditions played a role in their decision to pass.

Were the pilot cars doing their job effectively? Escort vehicles for oversized loads are meant to help manage traffic and ensure the truck can navigate safely. If they failed to position themselves properly or did not provide adequate warning, that could be relevant in understanding how the crash happened. Investigators should determine whether they were actively directing traffic or if there was confusion in their communication with other drivers.

Did broader issues contribute to the crash? Trucking companies and escort services are responsible for ensuring their drivers follow proper procedures when hauling oversized loads. If the company failed to provide adequate training or did not follow best practices for route planning and traffic control, that could be relevant in determining responsibility. Investigators should examine company policies, driver training records, and past safety violations to determine whether broader issues played a role.

At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity and closure they deserve.
