Commentary by Attorney Michael Grossman

People tend to see OSHA report fines and citations after a work accident and figure that’s the beginning and end of the story. The reality is OSHA investigations are often just the tip of the iceberg.

Texas has the most complex work fatality laws in the country. There isn’t always a guaranteed path for families to get the benefits they need or to hold people accountable after losing a loved one on the job. Sometimes, it takes navigating a legal maze, and that requires a significant amount of evidence and strategizing that OSHA simply doesn’t do on their own most of the time.

So, when I read about this shocking accident, I’m not thinking about how OSHA has all of this under control. I’m wondering if any ever took steps to address the needs of the worker’s family and ensure they had a clear path to getting a resolution that worked best for them.
