Houston police officials gave initial details about the incident, saying that Ricardo Alvarez Bautista was one of two workers working on a drainage hole by the entrance to the parking lot. Authorities claim there were no cones around the workers as a Dodge Charger pulled into the lot. The driver somehow struck Alvarez Bautista, resulting in fatal injuries. The other worker was apparently unharmed.

Commentary by Attorney Michael Grossman

Right now, there is no indication of the driver being charged. It is concerning to see details suggesting the workers had no cones set up, though it’s unclear if they had other visibility equipment. It raises questions about the safety procedures of their employer and whether the victim and his co-worker had adequate tools to do their job safely.

With that said, this still happened just after noon at a parking lot entrance. Generally speaking, a driver should be going relatively slowly, and they should be able to see something in or around the driveway pretty easily. Is there something unique about the visibility at this entrance? Or could it be that a more attentive driver would have avoided hitting the worker? It’s yet another angle investigators will have to look into if they’re going to get the victim’s loved ones the answers they deserve.
