Commentary by Attorney Michael Grossman

When authorities suspect alcohol played a role in a crash, one of the most important but often overlooked questions is where the driver was drinking before the accident. If the driver of the Range Rover was intoxicated, investigators should determine whether an alcohol provider over-served them.

Under Texas dram shop laws, establishments can be held accountable if they serve alcohol to someone who is obviously intoxicated. If an alcohol provider ignored their legal responsibility and continued serving the driver past that point, they may share responsibility for what happened.

Investigations into alcohol-related crashes should go beyond just the driver’s actions. Identifying whether an establishment contributed to the incident is essential for ensuring accountability and reinforcing the importance of responsible alcohol service. Taking these steps can help prevent similar crashes in the future. Is that something authorities are looking into, or does there need to be a second set of eyes looking things over to see these details get attention?
