Commentary by Attorney Michael Grossman

Especially considering this happened overnight in the downtown area, have authorities looked into where the alleged drunk driver was coming from? Too often, investigations into accidents like this begin and end behind the wheel. But if that person was coming from a local bar or restaurant, there could be a negligent alcohol provider who broke the law, as well.

Simply put, it’s unlawful in Texas for alcohol providers to over-serve people who are obviously intoxicated. If they do so, and that leads to people getting hurt, the alcohol provider can be responsible for their role in the accident. Allowing them to just ride off into the sunset and put all of the focus on an alleged drunk driver is only going to allow more people to be harmed in the future.

That’s why it’s important to know if authorities were thorough in their investigations. Holding alleged drunk drivers accountable is important, but it’s equally important to confront the negligent establishment who unlawfully over-serve them. Did that happen here?
