Commentary by Attorney Michael Grossman

When it comes to pedestrian accidents, my concern is people will too quickly jump to conclusions. They might put all of the weight of the situation on who had the right-of-way. As important as that factor is to consider, there could be extenuating circumstances. Poor signage, bad road design, alcohol, distraction, some sort of emergency, etc. If authorities don’t consider all potential factors, they risk letting the central issue of the accident slip through the cracks. Have authorities here been thorough enough to see that doesn’t happen?
