If all of these allegations prove to be true, then it may be all too easy to determine there’s a clear “bad guy” in all of this. Obviously, actions like those alleged here warrant consequences. But whenever alcohol contributes to an accident, it’s important to consider that there could be an accomplice who also needs to be held responsible: a negligent alcohol provider.

Simply put, a lot of drunk drivers involved in accidents were drinking at local establishments prior to getting behind the wheel. Those bars, restaurants, and other venues have a legal duty not to serve people who are obviously intoxicated. Doing so creates a deadly hazard, and it exposes those establishments to potential legal consequences, especially if people get hurt as a result.

Too often, though, this area of Texas law gets brushed aside. Authorities tend to move on from their investigations once there’s someone facing charges. But of the hundreds of families I’ve worked with affected by drunk driving, it wasn’t enough to just pin all of the blame on a single person. When they saw evidence that multiple parties broke the law and harmed them, they rightfully wanted to see all responsible parties face appropriate consequences.

So if the allegations surrounding this accident are true, there could be more to the story than just one reckless driver. At the very least, it’s important to ensure investigations are thorough enough to say for certain.
