It appears the victim was a man with others on the beach. Apparently while the victim and another were “play fighting,” the man ended up being hit by a passing Jeep. As a result, the man reportedly sustained serious injuries. Authorities did not report any pending charges relating to the accident.

Commentary by Attorney Michael Grossman

As open-and-shut as this all may seem, it might surprise people when certain areas of the law apply to a seemingly straight-forward accident. For example, was alcohol involved here? Texas alcohol providers often end up in the wrong by illegally over-serving someone who is already obviously intoxicated. If they do so, and the results in the person getting themselves or someone else hurt, the alcohol provider can face criminal investigations, fines, and even liability for the resulting injuries. Maybe that isn’t what happened here, of course, but I have yet to see enough evidence to feel confident there’s nothing more to the story.
