Commentary by Attorney Michael Grossman
As straight-forward as these details may seem, there could be more to the story worth looking into. Perhaps this intersection needs improvements to make things safer for pedestrians. The driver may have been intoxicated and coming from a local bar. There may be evidence the victim needs that authorities neglect to look for, such as video from a nearby security camera or data from the driver’s cell phone.
I’ve been handling serious accidents for over 30 years, and seemingly straight-forward accidents can give people a false sense of security. They assume everything will be open-and-shut, but then they encounter legal hurdles that require evidence or tools they don’t have and that authorities never bothered considering.
That’s why it can be crucial to be as thorough as possible after a serious accident. Doing so can be the difference between a victim reaching a subpar conclusion and a victim getting the resolution they deserve.
