Commentary by Attorney Michael Grossman
Current details allege that the Ford driver was under the influence of alcohol at the time of the accident. If that’s true, where was the driver coming from? This late on a Saturday, many drivers are coming from local bars and restaurants, and those establishments may also be responsible for contributing to the crash.
Simply put, if an alcohol provider over-serves someone who is obviously intoxicated, they can face criminal investigations, fines, license suspensions, and liability for the resulting injuries. Too often, though, the drivers take all the heat. Out of hundreds of cases I’ve handled against negligent alcohol providers, far too many were completely untouched by the authorities until we put the alcohol providers on their radar. If they break the law, and people get hurt, shouldn’t they, too, face appropriate consequences? I certainly think so, and so does Texas law. That’s why I have to wonder if authorities here are including these possibilities in their investigations.
