Commentary by Attorney Michael Grossman
After serious crashes, the first reports often feel complete even when they are not. Early summaries tend to focus on what was visible at the scene, while the deeper questions about how and why the collision unfolded can remain unanswered. That gap matters, especially when injuries are severe and the circumstances are not fully explained.
Did the authorities thoroughly investigate the crash? A proper investigation should go well beyond noting vehicle positions and damage. That means documenting exact points of impact, mapping how each vehicle moved before and after contact and reviewing what the driver was doing in the moments leading up to the crash. Some officers have advanced training in crash reconstruction, while others may be limited to basic scene review due to time or resource pressure. If this investigation did not include detailed measurements, vehicle path analysis or a careful review of driver actions before impact, important facts could still be missing.
Has anyone looked into the possibility that a vehicle defect caused the crash? When a vehicle strikes another car that is not moving, mechanical questions naturally follow. Brake performance, steering response, throttle behavior and electronic safety systems all deserve close inspection. Problems like delayed braking, sensor failures or unexpected acceleration do not always leave obvious marks. Without a full mechanical evaluation of the involved vehicle, a hidden defect could be overlooked.
Has all the electronic data relating to the crash been collected? Modern vehicles store valuable information about speed, braking, throttle input and warning alerts. Cell phone data, navigation history and nearby camera footage can also help confirm timing and driver behavior. This electronic evidence often tells a clearer story than witness recollections alone. If that data was not preserved quickly, it may be lost for good.
Crashes like this raise questions that deserve careful attention, not assumptions. Looking deeper helps ensure the outcome is based on facts rather than first impressions, and it helps everyone understand whether this collision was preventable or the result of something that went wrong beneath the surface.
Key takeaways:
- A full crash investigation requires more than a basic scene report.
- Vehicle defects should be ruled out through hands-on inspection.
- Electronic data can clarify what really happened before impact.
