Commentary by Attorney Michael Grossman
There is not a lot of information being reported at this time about this crash, but to me it seems to underscore the dangers of rural highways. Head-on crashes are more frequent there, in my experience, because there typically are narrow lanes with no barriers between them.
The focus of the investigation in this case will be determining what caused a head-on collision. Did one of the drivers cross the centerline or drift into the opposite lane? Authorities will need to determine if distraction, fatigue or impairment played a role. Cell phone records, toxicology reports and witness statements could be crucial here.
Tire marks, debris patterns and vehicle positions will provide vital clues about how the crash occurred. The physical evidence should be cross-referenced with driver statements and witness accounts to reconstruct the events.
Investigators also should scrutinize both vehicles to see if there was a mechanical issue that contributed to the crash, or whether the semi-truck had any issues with its load that might have affected its handling.
I also expect investigators to look into the truck driver’s training, driving history and compliance with hours-of-service regulations. Fatigue is a common issue for commercial drivers, particularly on rural routes.
Such details don’t make up all of what a complete accident reconstruction should cover, but these are the kinds of details I have seen authorities overlook many times during my 30-plus years litigations commercial vehicle accidents.
