Right now, additional details can’t be confirmed. However, the most up-to-date images of this intersection I can find clearly show that Berkley has a stop sign while Mallory does not. Does that mean this truck driver just pulled out in front of the victim? If so, it raises serious concerns about how a truck driver wouldn’t notice an approaching vehicle in broad daylight. Getting to the bottom of that, though, is often more challenging than people may realize.

For example, let’s take a common cause of crashes like the one described here: cell phone usage. A driver is looking at their phone, fails to see cross traffic, and gets into a serious accident. A distracted truck driver would likely face charges and be deemed at fault for the crash. Open-and-shut, right? Well, we had a case a while back that required more thorough investigations than authorities provided.

This is because the truck driver in that case was texting his supervisor due to reckless business practices. That supervisor micromanaged drivers all day and would constantly hound them with texts and calls. If a driver failed to respond immediately, they risked angering their boss, possibly even to the point of getting fired. Naturally, this led to drivers taking risks just to appease their unreasonable boss, and it predictably led to a serious crash.

In an example like that, if all of the blame just fell to the individual driver who was on their phone, it would let their negligent employer off the hook for creating an environment that made that mistake inevitable. That would just allow them to continue their reckless practices until one of their drivers caused another serious accident. By digging into the entire context of what otherwise seems to be a straight-forward situation, steps can be taken to hold all responsible parties accountable and to them on the straight and narrow before they harmed anyone else. That’s why when I read these preliminary reports, my concern is if authorities are overlooking anything that might have played a role in a family losing their loved one.
